Costody of my son

My and my bf of 5 years are seperating. We are selling the home and splitting it 50/50 everything is good. Our son is mine, of his fathers blood and shares his name (is a jr) but never signed the birth certificate and we never married. I want my son sun night-fri morning, and let my ex have our son fri morn-sun night. i want to go to court over it, but the ex still wants to recieve money from SSI for our son so is trying to get me to not go to court. Is this legal?! And when i first move i may have to have my son at my exs house for a wile before i can set up a room for him for over nights, once im settled in if i want to have my son sun-fri, and my ex take him fri-sun can i do that or will it be a hassle?

You have an absolute right to go to court.

The schedule described suggests that this the father will have physical custody with you having visits, or maybe maybe it will be joint physical custody.

If the father gets physical custody, you may be obligated to pay child support. Any income including SSI can be factored into the child support equation.
