Counseling

My husband has filed for a divorce (irr. breakdown) due to family pressure. I am contesting this divorce because I feel that counseling is what we really need. We are both over 40 and have been married less than three years. Can I ask the judge to order counseling before a decision is made?

Sorry, but the answer is no. Massachusetts is a "no-fault" state - so only one party needs to say they do not want to be married, not two. When a divorce is contested, it goes to the issue of asset distribution and support issues. I appreciate that this is a painful experience, and I am sorry to hear that your spouse does not share in your belief that counseling might save your marriage. But unfortunately, no court will force your spouse to try and save it.

The best thing you might consider doing is seeking whatever help and assistance is available to help you move forward and move on.
