I am going to court to emancipate my daughter who just graduated from college. I currently have a 19 year old daughter in college. I understand that I will be responsible for continuing to pay child support for 1 daughter.
Question: IF my former wife is remarried, and her new husband is paying $1,000 towards rent. Is that considered rental income? Will that amount be added to my former wife's income in calculating the child support? My former wife's new husband was in court last week for his divorce, and he stated under oath and in his 410 financial statement that he pays all utilities, cell phones, landscaping, etc. for their household. In addition he stated he pays $1, 000 a month towards the mortgage.

Technically, judges are to consider only the parties' incomes for purposes of child support. However, because your daughter is 18+, the judge has more discretion in determining the support amount, and therefore it may help to explain your wife's financial circumstances.
