Legal Question in Family Law in Massachusetts

i have a court order that says: if my daughter father misses 2 visits ten his visitation will be terminated, drop off and pick up will be at chuck e cheese in dartmouth. the mother has to wait 15 minutes before terminating that visit....my question is on 11/28/10 her father and i agreed that we would leave early and meet in 2 weeks at a bowling ally because thats where my daughter wanted to go. i have a paper he and i signed and it's dated. 2 weeks came and he didn't show up to the ally. 2 weeks later we had a snow storm and he called to cancel. 2 weeks after that he didn't show up at chuck e cheese. the both times he didn't show i have receipts with the date and time on it. will the paper we wrote out on our own and signed hold up in court?

Hello,

It is up to the Judge in your case to determine whether the piece of paper that you and your child's father signed is evidence that the both of you agreed to change the time and place of his visitation with your child. That being said, with the information that you provided, it looks to me that the father has missed 2 visits.
