Legal Question in Family Law in Massachusetts

I have a court order in place for visitation every other weekend over nights with my daughter and my support is up to date, but things keep coming up with her and her mother and they keep missing the days she is supossed to be here with me, I would like to give up my parental rights because I am tired of all the headaches and cant take it anymore...

You can't give up your parental rights unless someone adopts your daughter. I suggest a contempt to enforce your visitation rights.

I agree with Attorney Pransky. The law will not allow you to 'abandon' your child by giving up your parental rights. Your parental rights may be stripped by the state if you are deemed entirely unfit to parent and a potential harm to the child. You may also surrender your parental rights if there is another adult who is willing to 'adopt' the child and take on all parental responsibilities and duties.

Attorney Pransky is also correct in that, if the other parent is not living up to his or her obligations, you should bring a contempt action in court to enforce whatever custody or visitation order is currently in place.

I agree with the attorneys above, but I would add that you could give up your visitation rights. That would mean you would pay child support and not see your daughter.
