Legal Question in Family Law in Massachusetts

I have a court order signed by a judge stating that my ex husband's attorney is to submit payment for back child support as well as health insurance premiums FORTHWITH. It has been 2 weeks since receipt of the order and I have not received any money. What is the official timeframe for FORTHWITH and can I file a contempt charge against the attorney since he is the escrow agent of the funds the money will be coming from? This has been an ongoing issue since March 2010, and I cannot get the attorney to cooperate and release the funds. I cannot afford an attorney to handle this issue for me, so I need advice on how to handle this on my own. Thank you.

Some attorneys will work on a contingent basis, meaning that they will take their fee out of any funds which are collected on your behalf. You may want to hire one. It sounds like the other side is in contempt, and you need to let them know that. Good luck, and do not hesitate to contact my office if I can be of any assistance.

forthwith means just that-he is in contempt unless he has a valid reason for not releasing the funds.

If it really is the attorney who needs to pay, then forthwith means immediately. Today is better then tomorrow, is another way to look at it. I agree with the statement above, find an attorney who will work on a contingent fee basis for you. Especially when dealing with another attorney. If your husband's attorney doesn't want to pay that attorney should be able to drag out the matter.
