Legal Question in Family Law in Massachusetts

I was court ordered back in 2005 to have my ex-wife put on my health insurance with no additional cost to me. She has to pay me the difference in having an individual plan vs. a family plan. I�m getting married and want to put my wife to be on my insurance and I can't because she is on mine. I know in Massachusetts everyone has to have health insurance. Back when this started everyone didn't have to have it in Mass. Is there anyway I could get her off my insurance other than her getting married? I know she also has Mass health in addition to being on my insurance.

You need to read the court order carefully. Massachusetts law does not let you chose between your current wife and your ex-wife. It only allows you to cover your ex-wife as long as neither has remarried. This means that If you list your ex-wife and she has a major illness or injury, the insurance company can refuse to cover her. If you read the order, it probably has language that says you only cover her if you possibly can. Ift may also have language about what happens if you can't. Depending on what this language says, you may know what to do about her insurarnce. If not, you may have to return to court for instructions.
