Legal Question in Family Law in Massachusetts

custodial change for 16 year old girls in Mass.

I have three daughters, 16, 14 and

9. Their father has sole

physical/legal. He abuses them

emotionally and financially. He

neglects them. They care for

themselves most of the time.

The older two want to live with their

mother, have reported the abuse to

the GAL, who does not believe them

and states that mother isn't

supportive of father's relationship. In

addition, although these are A

students, with no trouble, she states

that these are ''teenage'' issues that

are very normal. Thus, they should

stay with Dad. Any help on this?

Re: custodial change for 16 year old girls in Mass.

I assume you have an attorney. About all you can do is ask for a psychological evaluation of the children by a trained psychiatrist.

Likewise, the opinion of a 16 year old should be given some weight by the court.

The problem here probably relates to why the children were not originally given to the mother for physical custody.

If your attorney is not a specialist in custody matters, you should contact someone who does custody battles as a major part of their practice.

Good Luck
