can a custodial parent in change the last name of 2 children ages 9 & 11 without the non custodial parents consent when they know the whereabouts?

No, the non-custodial parent must approve of the name change. If the non-custodial parent objects to the name change than it will be dealt with by the judge in the appropriate family and probate court.
