Do I have custodial rights in Mass even though our custody is through Indiana?

I recently moved away from my home state which is Indiana, I now live in Massachuttes. I have a custody hearing there on April 11th and am not happy with the current situation my exhusband is in. He got laid off his job over a year ago and still does not have one. He recieves unempolment and I know that it isn't enough for him to survive on w/our son. I have 2 jobs and my own place w/a roommate. I also feel in my heart that I can offer my son a better life and fulfill his needs better than his father, who by the way wasn't around for the first year or so. So do I have ANY custodial rights here in Mass that will help me bring my son to me?

Absolutely! The court always wants to do what is in the best interest of the child. If you feel you can better provide for him and have the means to do so and that you are of good moral character, you should contact the MA family court through an attorney and file a petition to seek custody. Of course this will be a much easier task if you and the child's father are in agreement. In any event, the Court will examine the situation and make the proper decision for your son.
