Custody Change

I have a 17 year old daughter who has been living with me for the last 3 months. She has mentioned to me that she would like to split her time between me and her mother. Her mother is the custodial parent at the moment. Is it possible to seek this custody change? How would I go about doing it?

You will need to file a complaint for modification of the divorce agreement.

Yes this can be done.

You have 2 choices:

1. If you ex does not agree, you file a complaint for modification. This seeks change of custody to joint physical custody, and a change in support or what ever other issue may be involved.

2. The better is to file a joint complaint for modification, should your ex agree.

I agree with other counsel. First, tell your ex-spouse what you want to do. If she'll agree, you can file a complaint for modification and then an agreement, modifying custody and, presumably, child support. If not, you file a straight complaint for modification.
