Custody of minor son before divorce

My husband and I are contemplating divorce and I would like to move with my mother in TX. My husband is fine with this decision. I would like to know how to go about making this legal, without getting divorced, just in case he changes his mind. Are we able to just write out our own statement and get it notarized?

You may retain an attorney to draft a Separation Agreement which will be a binding contract that may be submitted to a divorce court with a mutual request it be incorporated by reference into a Divorce Judgment. Good Luck!
