Legal Question in Family Law in Massachusetts

custody of nephews and nieces

MY brother and his wife are about to loose their 4 children to mass dss. My husband and I live in Rhode Island we would like to take these children in, as we know that they will be well taken care of. How do we go about to make sure these children don't be come wards of the state and seperated. I think it would be best for these children to be with us, in a clean and loving home, where they will have structure and proper care.

In order to permanently take your neices and nephews from your brother, a hearing has to be held before the Probate and Family Court. I would suggest you retain a Massachusetts Attorney and contact DSS. Your attorney would file a Petition for Guardianship of the Children on behalf of you and your spouse.

You need to get into the Juvenile Court and put yourself forward. You need to have as much help as possible. You should engage a lawyer for assistance if it is at all possible.

Yes, if certain steps are taken. There is a way for DSS to go through an interstate process. It is slower, but possible.
