Legal Question in Family Law in Massachusetts

Custody

I share joint legal custody of my 5 1/2 year old daughter with her father who has sole physical custody. We were never married. I am moving to Florida in 2 weeks and she is staying in MA with her dad. Is there any possible way that he can say that I am abandoning her and have someone adopt her without my permission? Can he deny me internet (web cam) and phone contact with her without changing the custody agreement? We have a very vague agreement currently that has no time or day limitations. Is giving him and his attorney my new address and phone number enough? I am not willing to give up my legal rights to her and still want to be very involved in her life. Can he stop me in any way because I am moving?

You may want to speak with an attorney before you leave. Do you have a custody and support order from the court, or a more informal agreement between the two of you.

If the latter, it may be time to have that agreement reviewed and modified.
