Have your daughter write in her own handwriting an affidavit telling her story and why she wants to live with you rather than with her mother. Have her make several copies.
Do not influence her in any way.
Have her go to the court. She can get help from a victim witness advocate or from someone in the family service department. They will help her file it with the court and ask to see the judge.
