Can my daughters father stop me from moving from ma to sc

Hello,

Depending on what the laat court order you have says with regards to you leaving the Commonwealth with your child on a permanent basis, without the Father's permission you would have to petition the courts to allow you to move out of Massachusetts with your child. I suggest you consult with an attorney before you move forward.

You need either the permission of the father or the Court to move your daughter out of state. While the court has a liberal view of allowing such moves for a good reason, you still need their permission and the father can contest it. I would suggest you retain counsel to assist you.

Are the parties currently operating under some sort of court order with respect to custody of the child?

If not, you may be able to move without the permission of the father or potential fathers. If the father is on the child's birth certificate or has otherwise been adjudicated to be the father, you would be wise to seek his permission or the permission of the court before making such move.
