First of all I would need more information about your situation.
If you have an action in any court related to the children, you need the court's permission. If there is any order related to the kids such as a probate court order, or a divorce decree then you need the court's permission.

You are not subject to arrest if you have physical custody of the children. ANyone saying otherwise is playing mind games.
If you are or were married, -and- your husband was the father of the children, you need the husband's or the court's permission to move out of state. So long as your reason is not absurd, the court is likely to allow the move. No such statutory restriction exists for children born out of wedlock. However, it is always good to seek permission.
The Massachusetts courts are very reasonable about these moves, so long as the mother's move is in good faith, will provide the mother (and therefore the children) with a "real advantage," and thus also reflects the best interest of the children. The court will impose reasonable visitation terms depending on the distance of the move.
