Legal Question in Family Law in Massachusetts

dismissal of divorce

My wife filed divorce case in Dec. 2006. We have been through the discovery period and have set up the second court day in Sept. However, two month ago, I lost my job. Now I got a dismissal letter based on the fact I have no job now. What should I do at this point if I want to pursue the divorce?

Re: dismissal of divorce

This makes no sense. The case cannot be dismissed without your consent.

If wife is moving to dismiss the divorce, you oppose the Motion, and ask the court by motion to allow you to file a Counterclaim (your own claim for divorce) late.

Your employment status has no legal bearing on whether you want (or should obtain) a divorce.
