If my divorce agreement states my ex-husband can claim our son on his taxes but I've been claiming him for the past 10 years, will I have to pay that back?

Your answer depends on what legal action your ex-husband takes. Your ex-husband may file a Complaint for Contempt claiming that you violated the court order (divorce agreement) by claiming your son. This is not a cut and dry issue and a lot depends on the circumstances.
