Im getting a divorce and not contesting it, I have a son from previous relationship and have full custody of him, can she get him in the divorce when he is mine?

Assuming your spouse has not adopted the child, she has no rights to a child where she is not a lawful parent. Step parents have no rights.

Unless your spouse adopted the child she has no rights to custody of the child. Step parents do not have parental rights or any rights to the Spouses child.
