Legal Question in Family Law in Massachusetts

divorce

I have been divorced since sept. 2004 and was married for 20yrs to my ex. In Mar 2006 my ex took my to court for child support, during the divorce hearing his lawyer said that alimony cancelled out child support because we would just be paying each other back, why is it that after almost a year and a half my ex could take me back to court for child support, I want to know if I still take him back to court for back alimony.

Re: divorce

You can seek future alimony, but if the court has made a judgment, that is final until there is a modification.

This assumes that you did not enter a non-modifiable agreement as to alimony at the time of divorce.

Re: divorce

Bring your divorce Agreement and Judgment to a lawyer who can determine whether their terms and current circumstances allow you to seek additional alimony.
