If I have proof that my wife has been engaging in extra-marital activities and we divorce who will be resposible for payments to the other.

Re: Divorce due to infidelity

Hi & Thanks for Writing -

Trying to use her "adultery" against her in a divorce proceeding won't get you very far, unless the issue affects any children you may have together, their safety, etc.

However, if you have separate property (property which you owned prior to the marriage) and the property has "maintained its character as separate and not marital property," then you should be able to exit the marriage with it.

Regards & Good Luck -
