Legal Question in Family Law in Massachusetts

How do I divorce someone I can't find?

I now reside in Va. We were married in MA, but have been seperated for almost five years. I do not know where he is at this time. How do I go about serving him papers if I don't know his address? How long does something like this usually take?

A divorce from someone whose whereabouts is unknown is commenced by the court advertising in a local newspaper of the pending action and giving the defendant an opportunity to appear and defend. The entire process usually takes about two to three months.

Since you are resident of Virginia, you must file for divorce in this state. Massachusetts has no jurisdiction, unless you husband resides here.

There are data bases available where you can try to locate your husband.

Weighing costs vs. benefits, I would seek a Virginia attorney to assist you.
