Divorce - Not Fulfilling Stipulation

Help! In our divorce agreeement in 1992, it states that upon my ex's retirement he will pay me a lump sum amount. He is refusing...what can I do?? Can I file a simple form with the court or do I need to hire an attorney or what??

Assuming you have a separation agreement that is enforceable, you can file a Contempt Complaint. I would suggest you use an attorney, but it is not absolutely required. In addition, your attorney can ask for costs including legal fees.

If your original attorney is still practicing I would suggest you contact him.

What ever you do, do it fast, since it is possible that he may bury the funds. You could also go in with the contempt and get an ex-parte order to halt the distribution or in the alternative halt the spending of any distribution, you may also be able to get a lien in the amount of funds that you expect to get. Again, do it fast!!!
