Legal Question in Family Law in Massachusetts
Divorce + Imigration Laws - potential implications on a green card - alien statu
I've been married for 4 years, we have a 3 year old daughter (american born). My husband is from Kansas City, and I am originally from Brazil. I have never been in this country illegally. In fact, when we got married I was under a work visa. 2 years after we wed, I got my green card. It ''expires'' August, 8 2004, when I assume I would be eligible for citizenship application. But, my husband wants to get divorce. He wants to do it right now, because ''after August I will have power since I wont need the green card anymore''. Hence, he wants me to agree to his terms: - half custody; - no child support; - leave the house and other assets untouched (100% his possessions). He has told me more than once that I have to start looking for a place to live, and since we will have half custody, I wont need child support, or alimony. He makes over 100k per year. I make 24k (which can be even less acording to sales perfomance). Today a mediator, who has been speaking with him for 6 weeks, called me to set up an appointment. He said if I dont agree with his terms, he wont provide immigration with required information to suport my stay in this country. I also understand that Massachussets is a ''no-fault'' state, what does it mean? What should I do?
