Legal Question in Family Law in Massachusetts

Divorce

We have been married 21 years. Husband left for 22 year old. To move forward we need the marriage license filed with state. We Can only locate the marriage certificate from the church. Seems no one filed with state. Nothing in archives in Providence either. Live in Ma married in RI. Are we still legally married?

If the marriage was proper, and there was a properly issued license at a point in time, then you are married. I cannot imagine the pastor would have married had you not shown the license.

You may have to file a motion with the court indicating the inability to locate the license, and to accept the church document instead.

You are legally married.

You can move forward with a good lawyer's help. The marriage certificate is only one way of proving a marriage occurred. Testimony is also a possibility.
