Legal Question in Family Law in Massachusetts

Divorce - Medical Insurance - Taxes

My Ex-wife and I are divorced. It was amicable. However, she is not holding up her end of the Medical and Dental insurance cost that was in the Separation agreement. I've carried her and our kids on the insurance since 2004, but she has not paid for 1/2 of it (as agreed) since the start of 2006, which is now 2+ years. SHE is claiming that because I was laid off in 2003 into 2004, and we still filed a joint return at that time (which was agreed upon by her, and that we would both be responsible for any taxes owed, etc.), that she should be entitled to the return she WOULD HAVE GOTTEN if we filed separately. Therefor, she feels she does not owe me this money... Do I have a case to get this money from her?

If the Seperation Agreement and/or Court Order says she is to pay half the cost of the medical and dental insurance she is in comtempt of court and you can bring a Contempt action against her for the money she owes you.
