Divorce for non-resident immigrant couple

We are non-resident immigrant couple presently in legal status in Massachussetts. We were married in 1998 in our native country and we came to the USA in 2003. Since we are non-resident immigrants, can we get a divorce through the US courts? Or do we have to get our divorce through the court of our own country?

Massachusetts has the necessary jurisdiction to grant you a divorce. You will need to prove your marriage through proper official documents -- a properly "sealed" marriage certificate with a certified translation. This divorce will be recognized throughout the U.S., and in most other nations. Your own native country's law should be checked on the issue of recognition.
