Legal Question in Family Law in Massachusetts

divorce

My sister has two small children, and lives in Massachusettes. She is planning on leaving her husband, and the question came up, can she actually move to Connecticut with me her sister? This is the only place she has?

Leaving the state before divorce is filed.

Before filing for divorce this is doable. After she would need the court's permission or the consent of her husband. There may be other complications which may impact my answer that she needs to discuss with an attorney, even one in Connecticut.

Re: divorce

This is America, she can go anywhere she wants. However, if she wants to file for divorce, she probably will have to do so in Mass. Once the divorce proceeding begins, the court will then have a say as to where she can travel.
