Legal Question in Family Law in Massachusetts

I'm divorced, and my ex-husband has been paying child support for our two daughters. Our oldest daughter will be twenty-one at the end of this month and he says he won't have to pay support for her then. She is still a full time student, can he stop paying her support, or does she get it until she graduates?

It is possible to receive child support until age 23 if in college. However, you must first read your divorce decree or seperation agreement to see what is written about termination. If it is silent on the issue, then he can't stop at 21 without a court order.

Child support can continue until the age of 23 in some instances. In any event, your ex-husband should not unilaterally terminate child support. You should sit down with an attorney to review your specific divorce decree or separation agreement and determine your rights.
