Can I get divorced in MA?

Mi wife and I were married in El Salvador about 20 years ago. I came to live in the USA in Massachusetts and she stayed in our country. I have no contact with her and I would like to get a divorce. Can I get a divorce here? What should I do? Thank you.

Since you have no contact with your spouse and assuming you have no idea where she is, you will still be able to get a divorce. You must give proper service by publication which you can obtain from the courts.

You can file for divorce here, but she can object to the jurisdiction of the court based upon the fact she has never lived here. However, if you serve her and she does not object, you can get a divorce here.

If you do file for divorce, she will be entitled to all the rights of any wife, even though you have not been living together for more than 20 years.

I would suggest you check with El Salvador, she may have already divorced you there if you have had no contact with her for that period of time.

You can obtain a Massachusetts divorce if you can obtain service on your spouse in El Salvador. You should consider that in going forward.
