Legal Question in Family Law in Massachusetts

I am divorced and have sole custody of my 9 year old son. I remarried to a woman in florida and want to relocate there, and take my son. The X is threatening resistense to this. What can be done?

You need permission of your ex-spouse or a judge. You can file a modification seeking permission to remove the child from Massachusetts. This can be expensive and time consuming. A better way might be to talk to your ex and figure out a way for permission to be granted. The parent in Massachusetts is likely to incur significant expenses and it may be worth your while to offer to pay these expenses. You can establish a budget for the parent to travel to visit the child. Between skype to have video visits and a number of visits during the year, your ex-may be agreeable. If you pay emough money to "compensate" for the additional cost your ex may agree to let you move.
