Legal Question in Family Law in Massachusetts

I have been divorced for five years, and I have been paying child support for two daughters. Their current ages are 21 and 18. My eldest daughter is in college and my youngest is about to attend college in September 2014.

I have been ordered to pay $8000 per year for each child's college tuition. My former wife is also ordered to pay $8,000.

My question is should I go back to court to reduce the child support payments as both children are attending college?

You should definitely reassess child support. Judges have broad discretion for child support for children 18 plus. And the new Child Support Calculation implemented in 8/03 generally lowered child support payments. You'll have to see what a current calculation would recommend and compare to what you're paying now and factor in the college expenses - and your current financial circumstances. Probably a good investment to at least ask an attorney to run the numbers for you and give you an opinion.
