Legal Question in Family Law in Massachusetts

I have been divorced for 26 years and receive alimony until I remarry or die. I am in my mid 50's and my ex stopped paying in Nov. 08 without any communication about it. I knew that he had been out of work (we have a son in his mid 20's). He has done the same thing in the past, paying smaller amounts until his finances improved. I never said anything to see how long it would take for the checks to resume. In the past, any court decisions regarding his child support late payments resulted in a reduction in the dollar amount and quite frankly, I can't afford to spend attorney fees to have the alimony reduced or eliminated. What is your recommendation?

It would be your ex's obligation to find a complaint for modification to get the alimony payments reduced. If you filed a contempt the only thing that the Judge can address is how much money he is in arrears and how much he will pay you back on a weekly basis until he is caught up. Therefore I would suggest filing a contempt complaint.
