Legal Question in Family Law in Massachusetts
My ex and I have been divorced for 10+yrs. I have been receiving the same about of support since day 1. Our 2 children our now 13 y/o and I have filed for a modfication for more support. My question is this. He is suppose to carry the medical insurance on the children but they are covered on his wifes family plan which is not costing him any money not is it costing his wife any additional money. Will the court take this into consideration when determining the support about?

When computing child support in accordance with the Massachusetts Child Support Guidelines credit is given to the parent who provides the support for the dollar amount that they contribute. He may argue that the amount that his wife pays for the family health insurance plan should be credited to him. Also, you may first want to run the guidelines both ways (giving him the credit and then not giving him the credit) so you can see the difference between the two.
