Legal Question in Family Law in Massachusetts

The house that spouse and I currently own has a third unit, an apartment that brings rental income. I would like to get the portion of the house that spouse and I own as part of the divorce settlement. The question is: even if I wind up NOT getting the house, in the meanwhile, is there an reason I could not live in that rental apartment? And even AFTER the divorce, is there any reason I could not live in that rental apartment, even though spouse would continue to live in the same house in the apartment in that house we both currently occupy?

Legally, there is no reason this cannot be worked out.

Emotionally, and therefore in the end legally, it is probably a bad idea. Most people cannot do this well.
