Legal Question in Family Law in Massachusetts

Spouse and I own a house which is co-owned with upstairs neighbor. In terms of the division of assets during the divorce, if I want to retain the house--that is, retain our portion of the co-owned house, does it matter, PRIOR to the divorce, if I do NOT remain living in the apartment in that house we both currently occupy or not?

It does not matter whether you continue to reside in the house while the divorce is pending, but generally the person who remains in the house will want to keep in once th divorce is final so you you may want to discuss this further with your spouse.
