Legal Question in Family Law in Massachusetts
Divorce/Immigration
My sister was married to a man (from the Domincian Republic)that had only his visa prior to her marrying him. She thought he married her for love, as to find out three-years of marriage, he now left her and is living with his girlfriend from back home and now has a baby from her. This all happended last year, my sister is a professional woman, who married this man from the Dominican Republic thinking he loved her we knew he was not right for her. As to find out once he received his residency he started to hit her, the home she bought he has destroyed the home and then he left her with the home destroyed. Now he also wants half of the house, she has three children and two of which are not his. This situation really bothers me because first of all, he hasn't been even in this country for no more than 10 years, he wants the American Dream to come over night on my sister's account. My sister has made all of the payments on her own, not only my mother helped her for a year in order for her to save for a home. I don't know why immigration provided him with his residency in the first place since his residency was expiring. Does he have legal right to take half of the house and can they reverse his legal residency since he most like?

Re: Divorce/Immigration
Your sister may be able to get the marriage annulled. She should definitely, under these facts, seek a restraining order. To get the protections she seeks, given these complications, she needs, at a minimum, to consult an attorney, and even more likely, to hire one.
