Legal Question in Family Law in Massachusetts
divorcing someone who has critical closed head injury
I have not been with my husband for 6 years. He has been living in Hawaii for almost 2 years now. I had been planning on filing for a divorce when I get my taxes back. He recently got into a critical accident-brain dead. Will I be responsible for his bills? Can I still seek a divorce? Will I still be responsible after a divorce. We have a minor child that lives with me. My husband's family have been the one's making the decisions for my husbands care ( I believe they wish to have him sent out here to a nursing home). Also, can I get social security benefits for my daughter.

Re: divorcing someone who has critical closed head injury
If your husband is brain-dead, they are unlikely to keep him on life-support. If he is a living vegetable, that is something else.
Assuming you have not signed any documents undertaking his medical bills, you do not have personal obligation for his bills. His estate will however be responsible for his bills.
If he is an invalid there are more complex issues involved. I suggest you contact an attorney and discuss the details with him so you can make an informed decision.
