Domestic Violence laws in MA

My husband has on occasion,

pulled my hair, kicked me, and

shoved me with his elbow. I

told him these actions are illegal.

Can you tell me which laws he

is violating and where to find

the laws? If I call the police, will

they automatically believe me

or would I need further evidence?

What you describe is civilly and criminall wrong. You can and probably should contact the police to protect yourself. Credibility is always an issue, and this is determined by what you say and if there are others who have seen this, and/or if there is bruising.

The prior answer is unclear. It also does not make clear that you have a problem which could escalate into more serious violence.

Your husband is committing abuse as defined at M.G.L. c. 209A. If you go to the District or Probate Courts, you can seek an Abuse Prevention Order (commonly called a Restraining Order). You can have him merely ordered not to abuse you, or have him ordered out of the house. These orders are rarely refused by the Court.

A police report will also be taken if you call the police. Thepolice will likely accept your sworn statement, and will likely seek issuance of a charge of domestic assault and battery, so long as you can give reasonably specific dates.

This man is angry, and his violence may escalate. I urge you to take steps to curb the problem.
