Legal Question in Family Law in Massachusetts

Dss case of physical abuse to child

Hi, I live in florida and have a friend in boston that has a dss case that is false. I found out that she should have asked for a fair trial, within 30 days. She did not know this. It's been close to 45 days and the case worker has found nothing to support these charges. She told her to write a letter to dss and request the case be closed. Should she do this, or can she still request a '' fair hearing '' ? Does closing the case with dss, mean that are are going to correct the false charges made against her?

Not sure how the Massechusetts dependency system works. If a charge is unfounded (false), the case is dropped or abandoned from any further investigations and that should be final.

Here in Florida it is a misdemeanor to file a false child abuse report. Your friend needs to explore that with the Mass dependency officials.
