Legal Question in Family Law in Massachusetts

DSS neglect

IF I am not being criminally charged and I am in the assesment phase of this alleged neglect, I have requested a fair hearing, Can I move out of the state with my children and still attend the hearing to clear myself of these allegations? I am 9 months pregnant and I do not want to add this child into this nightmare of false acusations and witch hunt digging where there is obviously no neglect.

Re: DSS neglect

If you have been found in neglect, and a juvenile court matter has been instituted, a move out of state will not end the nightmare. Indeed, if the juvenile court has not yet been invoked, your move out of state may cause DSS to go to court and seek custody, if the alleged neglect is serious enough.

You should find a good attorney in your area to help you with this matter.
