Legal Question in Family Law in Massachusetts

erasing videos from phone

My ex-boyfriend, who I have a daughter with, was verbally abusive to me. He is coming after me for custody. I taped 2 videos on my cell phone of him screaming at me while i was walking down the street. He knew I was taping him. When I went to compile my evidence of abuse, I realized he had erased the 2 videos. We were off and on at that time so he must have erased them one day when he was visiting.

Did he break any law by going on my phone without my permission and erasing the videos of himself treating me badly?

Re: erasing videos from phone

He may have broken a law against tampering with another person's computer, should the police want to stretch things. It might also be evidence/witness tampering, if there is any ongoing matter.

However, I would simply say this: ditch the guy permanently, and call the police the next time he pulls such crap. Seek a restraining order if you need protection.

Get the child support you need through an attorney.
