my father recently passed away without leaving a will he has no real money to speak of but he has money left from life insurance and my brother is the benificary and has discided not to split the money evenly between us what can we do to stop that from happening

I am sorry to say that your brother has no duty to split the proceeds of the insurance policy with you.

If he is the named beneficiary, then he is entitled to the proceeds. Whatever other assets your father had at the time of his death would be split amongst you according to statute.

Life insurance proceeds by-pass probate action. Unless you believe there is some fraud or some coercion, you are probably out of luck.
