Her biological father isn't around much if at all and rarely calls. Do I have any right towards her and do I need to file for custudy of both my kids if she moves to another state or can we have a written argement between us?

Your are considered a step-parent to your ex-girlfriend's 4 year old. If you were interested in adopting the child, you and your ex-girlfriend can petition the court for a step-parent adoption. The biological father's rights would have to be terminated, or voluntarily given up by him, in order for the adoption to proceed. Your situation is unique, and you should absolutely speak with a lawyer before going forward. Feel free to give us a call at 617-357-4898.
