Legal Question in Family Law in Massachusetts

Ex's Attorney

I served by ex on a contempt charge on 9/23 and he has 7 days to answer, which he didn't. In e-mails prior to his actually being served he informed me he will be getting a attorney 'to straighten me out once and for all' but I have never heard a word from any attorney. Doesn't that attorney have to contact me prior to going to court or can she/he just show up at the hearing on the 15th. I do not/will not have a attorney & told ex that and for him to just have his attorney contact me. I just would like to know if I will be going against a lawyer or the ex directly prior to the court date.

Re: Ex's Attorney

The new attorney, if there really is one, has no obligation to contact you prior to the hearing. If it's a new attorney, he can file a notice of appearance on that day and represent your ex.

However, after that first hearing, he will be representing your ex for the duration of the case unless he withdraws.

no, contact or notice is not required, nor is an answer. Contempt is one of those actions that unknowns exist.

If you need help, contact me.
