Legal Question in Family Law in Massachusetts

Failure for fund college account

In our divorce agreement, me and my ex agreed to contribute a specified amount each year to our children's college accounts. To date, my ex has not made his contributions. College is several years away. Should I seek help from the courts now or wait until college time is closer and see lump-sum payment at that time?

Re: Failure for fund college account

You are far better to file to contempt now than later, because the larger sum will be that much harder to get paid at that time. If ex-husband must be reigned in, do so NOW.

I would be happy to consult further.

I agree that you should pursue this now. Additionally, if the funds are placed in certain accounts, they could grow interest free.

Re: Failure for fund college account

I would file a contempt complaint to get the contributions made now. I would contact my divorce attorney and have him assist you.

Otherwise, I would contact another attorney for help with the contempt.
