Legal Question in Family Law in Massachusetts

false claims of child support deliquency

I was recently contacted by DOR indicating that my ex had contacted them and told them I was deliquent in payments. This is not true and I have copies of all cancelled checks--plus receipts for items we are to split (co-pays, etc). She said the money was not for child support and now they are attaching my pay. I am now out the money I paid her previously, as well as losing money going forward. What actions should I take and are there any consequences for false filing?

Re: false claims of child support deliquency

I suggest you request a hearing on Child support payments before the court to get the issue straightened out.

Also, you can arrange for your employer to deduct the money for your child support directly from your check.

Your wife will not get the money as quickly that way, as there is usually a loag time between the deduction and MDOR issuing a check.

Good Luck.
