Legal Question in Family Law in Massachusetts

family law

my kid finished high school last june. went to college in the fall. he flunked out in december and is currently working a job but intends to go back after he pays his student loan back. my question, am i still legally obligated to pay the child support to my ex wife, while he is on this leave of absense from school?

You must file a complaint for Modification requesting the child support be terminated or suspended if your child is not enrolled as a full time student. Good Luck!

It depends on what your separation agreement states or what your divorce decree says. You might not have to file a modification if you were not having your wages garnish or paying through the DOR.
