father and I were never married. child support ordered for 1 of 2 children. I have full custody, was never challenged because visitation was mutual. I now want to move out of state and would like to know my rights. Father is threatening to stop me. I am willing to allow him the kids summers and holidays.

Although you do have custody of your children, without the father's consent you will have to petition the appropriate county family and probate court for a removal of the children from the Commonwealth. There are several factors that would determine what your chances of success would be including but not limited to: the children's current visiting schedule with the father; the reasons for the move; and how the children's move would affect their relationship with the father.

Father has the right to contest your desire to relocate, and if you move without the court's permission, it could mean trouble.
